On August 17, 2020, the Centers for Medicare and Medicaid Services (CMS), issued revised guidance to state survey agencies regarding survey enforcement and prioritization activities. Does this signal a return to the new normal? What will federal enforcement actions look like as “suspended animation” of per day civil money penalties, denials of payment for new admission, and termination cycles are brought back to life? How will CMS and states integrate these standards with those governing enhanced enforcement sanctions for infection control deficiencies. In an environment where CMS is touting the increased number of immediate jeopardy citations and federal CMPs in excess of $15 million, skilled nursing facilities need to understand what lies ahead and how to prepare for this new onslaught of heightened scrutiny.
