On June 1, 2020, CMS issued a new directive to state survey agencies (SSAs) to perform 100 percent of their Focused Infection Control surveys by July 31, 2020 or risk losing a portion of the Coronavirus Aid, Relief and Economic Security (CARES) Act supplemental grants. Pennsylvania ranks 46th out of all states, having only conducted 16.3% of such surveys (the national average for SSAs is 51.4%). In addition, CMS has directed SSAs to conduct other COVID-19 surveys and resume some more routine survey activities.
CMS is also “ratcheting up” enforcement for facilities that receive a “D” or higher with any deficiency associated with Infection Control requirements.
We expect Pennsylvania to ramp up its on-site inspections in the next days, weeks and months. This webinar will provide the most up-to-date information about what this enhanced enforcement policy means for nursing homes, and strategies to mitigate potentially crippling new enforcement remedies.
