On Tuesday, October 4, 2016, CMS published in the Federal Register the final rule on the Requirements of Participation (RoP), Medicare and Medicaid Programs; Reform of Requirements for Long-Term Care Facilities.
Since that time, CMS has begun aggressively implementing the new requirements starting with Phase I in November of 2016, with Phase II and Phase III expected to be implemented in Nov. 2017 and 2019, respectively.
Phases of Implementation
There are three phases of implementation:
- Existing requirements that are relatively straightforward to implement and require minor changes to the survey process (November 2016)
- All Phase II requirements and those providers need more time to develop, foundational elements and a new survey process to assess compliance (November 2017)
- All Phase III requirements that need more time to implement (personnel hiring and training, implementation of system approaches to quality) (November 2019)
